This document establishes the terms and conditions that govern purchases made through the Website owned by Etnia Dreams S.L. (hereinafter, ‘THE COMPANY’ or ‘Etnia Cosmetics’), of products and services offered thereon (hereinafter, the ‘General Terms and Conditions of Sale’ or ‘T&Cs’). 2. ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF SALE By placing an order on the Website, you declare that you are aged 18 or older and have legal capacity to conclude contracts. If placing the order as a representative of a legal person, you declare that you have sufficient capacity to represent said legal person and to accept these T&Cs. Likewise, from the moment you place the order, having marked the checkboxes provided in the purchase form, you accept and commit to comply with these General Terms and Conditions of Sale. These T&Cs replace any other condition previously reflected in any other document. Consequently, you should carefully read these T&Cs before completing an order via the Website. The purchase will be understood as having been made at THE COMPANY’s registered address, indicated in the section above. THE COMPANY has the right to revise and change these T&Cs at any moment, with no prior warning. However, said changes will not affect any orders processed and delivered prior to said change. 3. PERSONAL DATA The information or personal data you provide to us will be processed in accordance to what’s established in the Privacy Policy included on this Website. By using this Website, you declare that the information and data provided are true, accurate and correspond to reality. 4. CORRECTION OF ERRORS ENTERING DATA The information or personal data provided during registration to the Website or during the purchase procedure may be corrected through your customer profile at any time. If you have already completed payment and subsequently need to edit any information that may affect the delivery of the products, get in touch with our Customer Service team. 5. PURCHASE PROCESS Before starting the purchase process, you must bear in mind that all products acquired from our website, www.etniacosmetics.com, are produced exclusively for Etnia Dreams S.L. Etnia products may only be sold by our own points of sale. In no case may any product purchased from www.etniacosmetics.com be sold in other points of sale. The colours of products may change slightly due to your monitor’s configuration. If the purchase button does not appear, this signals a lack of stock or availability for the product. You may write to pedidos@tiendaetniacosmetics.com to find out when this will become available. The purchase process is carried out in Spanish and is made up of several steps, which will be summarised below: a. Start of the purchase process

• Search for the product you need or wish to buy from our Etnia store and select it
• Check on the product page that this corresponds to your needs and select the shade and number of units
• Click the button: add to basket
• Check that the order is correct and click place order
• New customers will need to enter certain information, including your name or company name, address and email address, which must all be accurate and truthful. If you are already an Etnia customer, all you need to do is enter your email address and password to access your customer account.

b. Order completion Once you have entered all your delivery and billing information in the purchase and registration form, have selected your chosen delivery method and checked that all products added are correct, you will need to read and accept our ‘Privacy Policy’, our ‘Terms and Conditions of Site Use’ and these ‘General Terms and Conditions of Sale’. c. Order confirmation We will send your Order Confirmation to the email address indicated in the purchase form, with this being effective from its delivery date. d. Order shipment and delivery d-a Shipment Once you have received your Order Confirmation, we will deliver the product or products purchased via the Website to the postal address indicated in the order form. This may not correspond to a P.O. box or public place, such as a street, square, station, airport or similar. d-b. delivery Delivery will be made in the times indicated in the previous section following order confirmation, to the postal address that you have indicated in your order details, except in case of force majeure. You will assume all risk for the product upon its delivery, and as such you will be solely liable for it from this moment on. 6. PRICE, PAYMENT METHODS AND BILLING a. price All prices are indicated in EUROS and will be those published on the Website at the time of the order’s placement. The prices that appear on www.etniacosmetics.com are the same as those found in our physical shops (Etnia Cosmetics and shops located in El Corte Inglés). All prices include Value Added Tax (VAT) in accordance with current legislation. However, depending on the country of delivery, this excludes costs and taxes relating to order delivery and processing which, if applicable, will be indicated and added to the total price. Prices may change at any time; however, any possible changes will not affect orders for which we have already issued an Order Confirmation. b. payment methods Through the Website, THE COMPANY accepts the following payment methods: Credit/debit card

• You may pay using debit or credit cards.
• Your card details will be sent directly to the Stripe payment gateway. The Website has SSL certification (Secure Sockets Layer) and PCI DSS v3.2, global security standards that ensure that data delivery between the issuing and receiving system is carried out under encryption.
• No one within THE COMPANY may access your credit card details, neither during payment nor at any time thereafter.
• If your bank authorises the payment via your card, we will process your order.

PayPal

• PayPal allows any company or individual consumer with an email address to securely send and receive payments. By selecting the ‘Pay with PayPal’ option, you can access the PayPal secure website. Once there, if you already have a PayPal account, you will be able to authorise the payment.
• If you do not yet have a PayPal account, you can register for free, adding your credit or debit card in order to pay for your orders. The use of PayPal as a means of online payment is secure.

Sequra

• You may pay for your order in instalments with Sequra.

Bizum

• You can choose Bizum as a payment method to pay for your purchases quickly and easily.

b. billing You may request the issuance of an invoice for the purchase made by getting in touch with us via email at etnia@etniacosmetics.com or by calling 963 523 929. This will be issued, in Spanish, to the email address indicated to us. However, if at any time you wish to request a paper-format invoice, we will issue and deliver the invoice in this format. The electronic invoice will be stored in our servers for five years, as of the time at which it was issued by email. This way, should it become lost, for example, you can request it through our customer service team. 7. LEGAL WARRANTY IN CASE OF DEFECTIVE PRODUCT As a consumer, you have the right to be protected for a specified time period against any existing defects or lack of conformity in the products. If the product is delivered defective, in bad condition or is different from that which you ordered, you may make use of this warranty. This mandatory warranty implies a series of rights which you may exercise:

• Repair
• Exchange
• Price reduction
• Termination of the contract

Repair and exchange If the product is defective or does not conform with what you purchased, you may opt for repair or exchange, as long as one of these options is not objectively impossible or disproportionate. Exchange

• This will be free, as well as the related costs, in particular with regard to delivery and return costs that may be derived from the delivery of the new product and return of the initial product.
• This will be carried out within a reasonable time and without any major inconvenience, bearing in mind the nature of the products and their purpose.
• As soon as you request exchange, the warranty period will be suspended until we deliver the new product. The new product will not have a new warranty period, but will continue with the initial period.
• If the new product still does not conform with that originally purchased, you may choose: repair (unless this would be disproportionate), a price reduction, or termination of the contract (both explained below).

Repair

• This will be free, as well as the costs related with this, in particular with regard to delivery costs and any costs associated with labour and materials.
• This will be carried out within a reasonable time and without any major inconvenience, bearing in mind the nature of the products and their purpose.
• Once the product has been delivered for repair, the warranty period will be suspended until it is returned repaired.
• Once we have delivered the repaired product to you, we will respond to any repair defects that may arise for a period of six months.
• Furthermore, if the repaired product still does not conform with that originally purchased, you may choose: exchange (unless this would be disproportionate), a price reduction, or termination of the contract (both explained below).

Price reduction and termination of the contract: Price reduction

• You may exercise this right when repair or exchange is not available, or in cases in which these have not been carried out in a reasonable time or without major inconvenience.
• This will be proportionate to the difference between the value of the non-defective product or product conforming to that purchased, and the value of the defective product or product not conforming to that purchased.

Termination of the contract

• You may not exercise this right if the lack of conformity is minor.
• For all other cases, you may exercise this right when repair or exchange is not available, or in cases in which these have not been carried out in a reasonable time or without major inconvenience.

For how long do I have these rights? New products: Two years after the date appearing on the invoice or receipt, or on the delivery note if this is dated later. How do I exercise my rights? Bear in mind that: You must inform us of a defect or lack of conformity within two months of becoming aware of this, as you will be liable for any damage caused to us by any delay in your communication. However, you will still be able to exercise the aforementioned rights. A product is understood as non-defective or in conformity with that purchased if:

• It fits the description made by THE COMPANY and has the qualities indicated on this Website.
• It is suitable for the uses for which products of this type are usually intended.
• And, it presents the quality and services normally expected for a product of this type, bearing in mind the nature of the product and, if applicable, any public declarations regarding specific product characteristics that may have been made.

8. LEGAL RIGHT OF WITHDRAWAL AND RETURNS In compliance with Royal Legislative Decree 1/2007, of 16 November, which approves the consolidated text on the General Law for the Protection of Consumers and Users and other complementary laws (hereinafter, ‘Royal Decree 1/2007’), should you have the condition of consumer, according to the definition of this term in said regulation, you will have the right to withdraw from the sale within a period of 14 calendar days from the receipt of the products forming the subject of the sale, without the need to justify your decision and without any penalty, unless the sale refers to those products and/or services detailed in Article 103 of the aforementioned law, including, but not limited to, the following: The supply of sealed goods that may not be returned for health and hygiene reasons and which have been unsealed after delivery. Given the above, the right of withdrawal may not be exercised for products delivered to the customer sealed and which are not suitable for return for health and hygiene reasons if they are unsealed after delivery, such as makeup, for example. In any case, you may exercise your right of withdrawal as follows: How do I exercise my right?

• You must notify your decision to withdraw from the sale contract through an unambiguous declaration made by email to the address pedidos@tiendaetniacosmetics.com or by post to the address Plaza del Ayuntamiento, 6, 8º, Puerta 15, 46002, Valencia, including your contact details, order reference, delivery date and a photocopy of your ID. For this, you may use this withdrawal form template. You may also make your return via the direct link to the returns form that you will find in your order confirmation email.
• You can return the goods or deliver them directly to one of our stores (not including Etnia stores in El Corte Inglés establishments). You can also return the products via ordinary post, with the customer bearing the costs of said delivery.

To comply with the withdrawal period, it will be sufficient for the communication relating to the exercise of said right to be delivered before the expiry of the corresponding period. In case of withdrawal in accordance with this Clause, THE COMPANY will return all payments received with regard to the purchase subject to withdrawal, including any delivery costs that may have been charged – corresponding to the cheapest delivery option offered – no later than 14 days following the day on which THE COMPANY received the aforementioned communication. However, the costs that may be derived from the return of said products will be borne by the customer. THE COMPANY may make said refund using the same payment method you used for the initial purchase transaction, unless another payment method is expressly agreed. The above notwithstanding, THE COMPANY may retain the refund until the goods forming the subject of the sale have been received, or until you present proof of their return, depending on which condition is met first. 9. You can also get in touch with us via our web chat or through our social networks. As a consumer, you may request complaints forms from THE COMPANY’s registered address. 10. THE COMPANY’S LIABILITIES THE COMPANY cannot be held liable for (i) losses not attributable to any non-compliance on its part, (ii) business losses (including loss of income, revenue, profits, contracts, data, or unnecessary expenses incurred) or (iii) indirect or consequential losses that were not reasonably foreseeable by both parties at the time at which the contract for the sale of the products was signed. No provision contained in these conditions limits or excludes our liability in case of misrepresentation, death or personal damage attributable to negligence or wilful misconduct. Please bear in mind that this does not have any effect on your legal rights as a consumer as provided in Royal Decree 1/2007, nor on your right to return products in accordance with clause 8. 11. WRITTEN COMMUNICATIONS Through the use of this Website, you accept that the majority of communications with THE COMPANY will be electronic. For contractual purposes, you agree to use this electronic means of communication and acknowledge that all contracts, notices, information and other communications that THE COMPANY sends electronically comply with the legal requirement of being in writing. This condition does not affect your rights as recognised by law. 12. NOTICES In accordance with the provisions of clause 11 above and, unless otherwise stipulated, THE COMPANY may send you communications using either the email or postal address provided by you when placing an order. It shall be understood that communications have been received and carried out correctly either 24 hours after the delivery of an email, or three days after the posting of a letter. To prove that a communication has been made, it shall be sufficient to prove, in the case of a letter, that it carried the correct address, was properly sealed and that it was duly delivered to a post office or to a post box or, in the case of an email, that it was sent to the email address that you specified upon the order’s placement. 13. TRANSFER OR RIGHTS AND OBLIGATIONS In case of a purchase made via this Website, these T&Cs are binding both for you and for THE COMPANY, and for any respective successors or assignees. You may not transmit, assign, encumber or otherwise transfer your contractual position or any of the rights and obligations resulting therefrom in, without having obtained THE COMPANY’s prior written consent. 14. ONLINE DISPUTE-RESOLUTION PLATFORM In accordance with that established in Article 14 of Regulation (EU) No 524/2013 of the European Parliament and the Council of 21 May 2013, regarding the resolution of online consumer disputes, amending Regulation (EC) No 2006/2004 and Directive 2009/22/EC, consumers may make use of an Online Dispute-Resolution Platform, which may be accessed at the following link: https://ec.europa.eu/consumers/odr/main/?event=main.home2.show&lng=ES. Through this link, users of the Website may access the European Online Dispute-Resolution Platform. If you have encountered any issues with a purchase or provision of an online service, you may use this platform to present any claim regarding said purchase or provision of services, or opt for an out-of-court settlement of the aforementioned conflict. A direct link has been established in the ‘footer’, at the bottom of the Website, to allow consumers easy access to this platform. 15. PARTIAL NULLITY If any of these T&Cs is declared null and void by a final decision by a competent authority, the remaining terms and conditions will remain in force, unless they are affected by said declaration of nullity, and the null or inapplicable clause will be replaced by another that most closely approximates the previous one. 16. FORCE MAJEURE Neither you nor THE COMPANY will be liable for any non-compliance of these T&Cs caused by force majeure outside of your control. Any act, event, failure to exercise, omission or accident outside of reasonable control is understood as force majeure, including, but not limited to, the following: strikes, lock-outs or other industrial action; natural disasters; civil disorder; terrorist threats or attacks; and an impossibility of using trains, planes, motor transport or other means of transport, among others. It will be understood that obligations will be suspended during the period in which the cause of force majeure continues, and we will extend the period for complying with said obligations for a period of time equal to the length of the cause of force majeure. APPLICABLE LEGISLATION AND JURISDICTION The contract for the purchase of products made via this Website will be governed by Spanish legislation. Any dispute that may arise relating to the use of the Website or with said contract will be subject to the non-exclusive jurisdiction of the judges and courts of Spain, with the corresponding judge or court deemed competent in accordance with current regulations. Notwithstanding the above, if you conclude the contract as a consumer within the terms of Royal Decree 1/2007, nothing in this clause affects your rights as such under applicable legislation.
